Beware the Employment risks of Social Media
According to the EU, Irish internet users are the fourth heaviest users in Europe of social media
websites at 68% of the population.
Websites such as Facebook, Linked-In and Twitter have become a
part of day to day life.
The rapid expansion of the use of smartphones, means that users can readily
access these sites from any location.
Often when posting messages they do so in a casual manner
with little thought to the public nature and consequences of the comments.
An example of this is the
recent Employment Appeals Tribunal (“EAT”) case of Aoife O’Mahony v PJF Insurances Limited
(UD933/2010).
PJF Insurances were an insurance brokerage consisting of two directors (who are husband and wife)
and three clerical assistants, once of whom was Ms.
O’Mahony.
On the 14th January 2010 Ms.
O’Mahony was called to the director’s office to discuss a number of work matters, one of which was a
request that she “tone down” her demeanour with customers.
