1 Global March Against Child Labour International Conference on Child Labour in Agriculture Washington DC, USA July 28-30, 2012 FRAMEWORK OF ACTION This International Conference on Child Labour in Agriculture (28-30 July 2012, Washington D. C. , U. S. A. ): organised by the Global March Against Child Labour; and attended by 156 participants from governments, intergovernmental agencies, trade unions, teacher organisations, non-governmental organisations (NGOs), agriculture producers organisations (hereafter referred to as APOs), cooperatives, multi-stakeholder initiatives and corporations from over 39 countries. RECOGNISES THAT a strong and sustained worldwide movement against child labour is essential to attain the elimination of child labour and in particular of the worst forms of child labour by 2016 (as required by The Hague Roadmap adopted in 2010), in line with the UN Convention on the Rights of the Child and the relevant ILO Conventions. FACTS ON CHILD LABOUR 2010 For over a decade, child labour has been recognized as a key issue of human rights at work together with freedom of association, the right to collective bargaining, the abolition of forced labour, and non-discrimination in occupation and employment. However, despite the large social reform movement that has been generated around this issue, more than 200 million children worldwide are still in child labour and a staggering 115 million at least, are subject to its worst forms. The global campaign to end child labour is at a critical juncture. As the new Global Report under the follow-up to the ILO Declaration on fundamental Principles and Rights at Work* shows, child labour continues to decline worldwide but at a much slower pace than before. The document represents a snapshot of publicly known policies and programs, and does not purport to be a comprehensive or intensive study of all U. S. government programs or policies that may affect the central issue of child labor, directly or indirectly. Rather, it is meant to provide a layman’s guide to U. S. policies in this area. Since the mid 1990s, the United States has demonstrated global leadership on the important human rights challenge of ending child labor worldwide. In the 1990s, the public became increasingly sensitized to the problem of child labor, galvanized by media reports on child labor in garment factories in Central America and Bangladesh, soccer ball production in Pakistan, and other exposés. 1 Section I: Introduction In November 2009, the US Department of Labor (DOL) issued an official report to the International Labour Organization (ILO) on the measures taken to give effect to the provisions of ILO Convention 182, the Worst Forms of Child Labour Convention. 1 The report notes that "United States Government remains strongly committed to the elimination of the worst forms of child labor" and describes a variety of steps the US has taken to implement the Convention. This "shadow report" is intended to complement the official US Government report by evaluating the US compliance with the Convention. It demonstrates that the US is not meeting its obligations under the Convention and that urgent action is needed to protect child laborers in the US and bring the US into compliance with the Convention. What is the CaRe aCt? The CARE Act (H. R. 3564), introduced by Representative Lucille Roybal Allard (DCA), is legislation that would amend the Fair Labor Standards Act of 1938 (FLSA) to address inequities in current labor laws that currently allow farmworker children to work longer hours, at younger ages, and in more hazardous conditions than children working in other sectors. Why is the CaRe aCt neCessaRy? The CARE Act takes a critical first step in protecting the safety, health and overall wellbeing of the estimated 400,000 children employed in the United States agricultural industry. Children as young as twelve years old currently work long hours under extreme weather conditions on farms throughout the country. These children work with hazardous tools and heavy machinery that can lead to fatal accidents or loss of limbs.
