You want to make sure before entering into a cell tower lease agreement with any of the wireless carriers doing business (ATT, Sprint-Nextel, US Cellular, Metro PCS, ClearWire, Verizon Wireless, Alltel, TMobile) or sign a contract with any of the large tower development or rooftop management companies (AAT, Crown, American Tower, SBA) that conduct your due diligence, but don t wait too long. Negotiating a Cell Tower Lease By Ken Schmidt A recent survey of the FCC s antenna structure registration database showed that in 2001 there were roughly 89,000 antenna sites registered with the FCC. Today, there are over 109,000 registered sites. It is important to note that most towers under 200 are not required to be registered, so there are significantly more towers in the US than this number suggests. All of these sites are on someone s property, whether the tower company or antenna site owner owns the land underneath it or is leasing it. Over the past 5 years, the tower companies and wireless carriers have predominately chosen to lease land rather than buy it. Assuming that the increase in antenna structure registrations constitutes just 50% or all new leases, in the last five years, that yields 40,000 new cell site leases. By Ken Schmidt While cell towers actually started being built in the late 1970 s, the boom in development did not really start until Congress passed the Telecommunications Act of 1996. Instead of having two wireless providers in any one area, customers now found that there were up to eight companies with licenses from the FCC to provide Personal Communications Service (PCS) in their area. Initially, each wireless provider built its own towers and rarely collocated (shared) on the other s towers. This made for rapid development of communication sites and towers and a plethora of landowners with cell towers on their property. As you can imagine, many landowners had little to base the lease negotiations on and signed agreements that were substandard in comparison to today s lease rates.
